Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and FlickUp AI, Inc. ("FlickUp," "Stacks," "we," "us," or "our") and govern your use of jasonstacks.com and our interactive AI experiences — including Men vs. Gorilla, Instant Baby Generator, World Record City, This Company Doesn't Exist, and any other experience we release (each, an "Experience," and together with the site, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services, and you must meet any higher age requirement stated within a particular Experience. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian. By using the Services you represent that you meet these requirements.

2. Your content and the license you grant us

"Your Content" means the photos, images, text, prompts, ideas, and other materials you submit to the Services. You keep all rights you already have in Your Content.

You grant FlickUp a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, process, and display Your Content and any AI output generated from it, as needed to operate and provide the Services. For Experiences that are public or collaborative, this includes displaying that content publicly within the Experience. This license ends when you delete Your Content or your account, except for content already shared publicly or where retention is required by law or for backups.

3. Acceptable use

You agree that you will not, and will not allow anyone else to:

• Upload a photo of another person without their permission, or any image of a minor.
• Submit content you don't have the rights to, or that infringes anyone's intellectual property, privacy, or publicity rights.
• Upload or generate content that is unlawful, hateful, harassing, sexually explicit, defamatory, or that depicts real people in a false or harmful way.
• Use the Services to impersonate or deceive, including creating misleading "deepfakes" of real people.
• Interfere with, scrape, overload, reverse-engineer, or attempt to bypass rate limits or security of the Services.
• Use the Services for any illegal purpose or in violation of these Terms.

We may remove content and suspend or terminate access for any violation.

4. AI-generated content

The Services use artificial intelligence to generate images, video, and text from your inputs. Outputs are produced automatically and may be inaccurate, unexpected, offensive, or fictional. Many Experiences are works of satire or entertainment — for example, companies, people, statistics, and events depicted may be entirely fictional. We make no guarantee about the accuracy, quality, or suitability of any output, and you are solely responsible for how you use it.

5. Intellectual property

The Services, including their software, design, branding, and the "Stacks" and "FlickUp" names, are owned by FlickUp and protected by law. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. You may not copy, sell, or exploit any part of the Services except as expressly permitted.

6. SMS messaging

If you provide your phone number, you consent to receive a one-time verification code and, if you opt in, occasional new-drop notifications by SMS. Message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time and HELP for help. See our Privacy Policy for details.

7. Third-party services

The Services rely on third-party providers and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is at your own risk and subject to their terms.

8. Disclaimers

The Services and all outputs are provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the fullest extent permitted by law, FlickUp and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed USD $100 or the amount you paid us in the prior twelve months, whichever is greater.

10. Indemnification

You agree to indemnify and hold FlickUp harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Services, or your violation of these Terms or anyone's rights.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination will survive.

12. Changes

We may modify the Services or these Terms at any time. When we change these Terms, we'll update the "Last updated" date above. Your continued use of the Services means you accept the changes.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in New York for any dispute not subject to other agreement.
